1. Introduction:
This liability policy outlines the terms and conditions under which Swift Transit (hereafter referred to as “the Company”) assumes liability for the transportation of goods entrusted to it by customers.

2. Scope:
This policy applies to all shipments handled by the Company, whether domestic or international.

3. Liability Limitations:
3.1. The Company’s liability for any loss, damage, delay, or non-delivery of goods shall be limited to the lesser of:
a. The actual value of the goods at the time of shipment, as evidenced by the invoice or other relevant documentation; or
b. The limits specified by applicable international conventions or local laws governing the transportation of goods.

3.2. The Company shall not be liable for any indirect, consequential, or punitive damages arising from the transportation of goods, including but not limited to loss of profits, business interruption, or loss of market value.

4. Exclusions:
The Company shall not be liable for any loss, damage, delay, or non-delivery of goods resulting from:
4.1. Inherent vice or nature of the goods.
4.2. Improper or inadequate packaging by the shipper.
4.3. Acts of God, including but not limited to natural disasters, weather conditions, and civil disturbances.
4.4. Acts of war, terrorism, or political unrest.
4.5. Acts or omissions of the shipper or consignee, including improper labeling, marking, or addressing of packages.

5. Claims Process:
5.1. In the event of loss, damage, delay, or non-delivery of goods, the shipper or consignee must notify the Company in writing within a reasonable period, not exceeding [insert time frame] from the date of delivery or expected delivery.
5.2. Claims must be submitted in writing and include all relevant documentation, such as invoices, packing lists, and photographs of the damaged goods.
5.3. The Company reserves the right to inspect the goods and investigate the circumstances surrounding the claim before making any settlement.

6. Indemnity:
The shipper agrees to indemnify and hold harmless the Company against any claims, liabilities, damages, or expenses arising from the transportation of goods, except to the extent caused by the Company’s gross negligence or willful misconduct.

7. Insurance:
The Company strongly recommends that shippers obtain appropriate insurance coverage for their shipments to supplement the limited liability provided under this policy.

8. Amendments:
The Company reserves the right to amend or update this liability policy at any time, with or without prior notice, to reflect changes in applicable laws, regulations, or business practices.

By entrusting goods to the Company for transportation, the shipper acknowledges that they have read, understood, and agreed to the terms and conditions of this liability policy.
